Indian Point is a strictly enforced Deed Restricted community as created by Greater Construction in 1994. As stated in the Covenants, Conditions and Restrictions, also known as the Deed Restrictions, your compliance is required. All homeowners, their tenants and property managers are required to comply with these rules and the Osceola County Ordinances that govern our community or face assessment of a violation, fine and further legal action.
 
Homeowners are responsible and liable for all violations assessed by their tenant and/or property manager.
 
As per Florida State Statute, failure to comply with the Covenants, Conditions and Restrictions of the Indian Point community will result in assessment of violation and fine, starting at $100.00 per day per violation.  Continued violation can result in further legal action, not limited to placement of liens and foreclosure on a property.  With the homeowner legally responsible for all legal costs involved with such action for violation of the Indian Point Deed Restrictions.  Suspension of privileges will also result.
 
Florida Statutes require that the seller provides the buyer with a set of Covenants, Conditions and Restrictions pertaining to their property.  Simply since you were not provided with these documents does not exempt you from compliance, assessment of violations, fines and legal action, not limited to assessment of liens and foreclosure.  To obtain a copy of the Covenants, Conditions and Restrictions contact Osceola County Clerk of Courts, a fee might be charged.

 

Notice of Covenants, Conditions and Restriction for Indian Point

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, THE GREATER CONSTRUCTION CORP, a Florida corporation, is the owner of the following real property located in Osceola County, Florida, to wit:

Lots 101 through 784, inclusive, INDIAN POINT PHASES ONE through SEVEN, according to the Plat thereof, recorded in Plat Book Public Records of Osceola County, Florida.

AND WHEREAS, THE GREATER CONSTRUCTION CORP. desires that all of said real property be subject to like restrictions for the mutual benefit and protection of themselves and persons, both natural and corporate, who may hereafter purchase or acquire any interests in said real property, or any portion thereof;

NOW THEREFORE, in consideration of the premises, THE GREATER CONSTRUCTION CORP., the owner of all the real property described above, and hereinafter sometimes referred to as "the Declarant" does hereby declare said real property to be subject to the following restrictions, reservations and conditions binding upon themselves and upon each and every person, both natural and corporate, who or which shall hereinafter acquire any interest in said real property, and their heirs, successors and assigns, to wit:

IN WITNESS WHEREOF, THE GREATER CONSTRUCTION CORP. has caused these presents to be executed by its duly authorized officers and its corporate seal to be hereunto affixed this 12th day of April, 1994.
